The National Rental Home Council (NRHC), representing America’s leading providers of single-family rental housing, issued the following statement regarding the U.S. Supreme Court’s ruling to end the nationwide CDC moratorium on residential evictions:

Washington, D.C. (August 27, 2021) – The decision of the Supreme Court affirms one of the most basic and long-standing tenets of American democracy – the right to ownership of real property. In its ruling, the majority addressed the dangers posed by the CDC order on the inherent rights of rental home property owners:

The moratorium has put the applicants, along with millions of landlords across the country, at risk of irreparable harm by depriving them of rent payments with no guarantee of eventual recovery. Despite the CDC’s determination that landlords should bear a significant financial cost of the pandemic, many landlords have modest means. And preventing them from evicting tenants who breach their leases intrudes on one of the most fundamental elements of property ownership—the right to exclude.

Supreme Court Opinion

“NRHC’s position regarding the CDC eviction moratorium has been clear since the order was enacted nearly a year ago – we respect the right of the government to respond to public health emergencies as needed,” said David Howard, executive director of National Rental Home Council. “NRHC member companies will continue working with residents experiencing financial hardship as a result of the COVID health crisis. Since the beginning of the pandemic in 2020, NRHC members have provided tens of millions of dollars in rental assistance and forgiveness and have instituted a range of programs designed to ensure residents impacted by COVID are able to remain in their homes.”

NRHC encourages all renters and property owners experiencing financial hardship as a result of the COVID health crisis to seek relief through the federal government’s emergency rental assistance program. NRHC continues to support the efforts of the Biden administration in calling for a more rapid distribution of funds.
